How to get out of a merchant cash advance
This page is written for 2026. Getting out of a merchant cash advance is not a slogan and it is not another advance. It is which real path fits the file: the ACH, the stack, the contracts, the UCC, the guarantee, and whether you have been served, frozen, or hit with a confession of judgment.
St. Germain Strategy is a consulting firm for US business owners. We are not a law firm and we do not provide legal advice. We are not a debt settlement company. We do not hold client funds. We do not file. When a file needs licensed counsel, we will say so. See how we work a file and MCA debt relief.
The real paths
- 01
Reconciliation
Some contracts have a reconciliation or true-up against actual receipts. That is a contract path, not a mill pitch. Diagnosis starts with whether the contract actually has it.
- 02
Refinance / take-out
Replace the MCA with a facility the cash flow can hold and kill the daily debit. Another MCA is not take-out. As of 1 June 2025, SBA SOP 50 10 8 / 7(a) cannot refinance merchant cash advances. Refinance the MCA.
- 03
Negotiate
If take-out is not available, work a hardship file: reduced payment or a defined payout, then close docs. From a file, not from panic. Negotiate a merchant cash advance.
- 04
Legal restructure with counsel
If the funder will not cooperate — or if you have been served, frozen, or hit with a confession of judgment — that is licensed counsel. We prepare a file counsel can use. We do not file. We do not stop ACH as the actor.
- 05
Bankruptcy
A legal path, not a consulting product. We do not file. We do not file Chapter 11. Licensed counsel decides whether that path fits. We will say so if the file is there.
Which path fits
Honest matrix. Not a promise. Not a result.
| Path | Fits when | Does not fit when |
|---|---|---|
| Reconciliation | The contract actually has a reconciliation or true-up against receipts. | The contract does not have it. A mill script is not a clause. |
| Refinance / take-out | Cash flow can hold a replacement payment. The stack and UCC can be packaged. | SBA 7(a) takeout (not allowed for MCAs as of 1 June 2025). Another MCA labeled consolidation. Stacking as the plan. |
| Negotiate | Take-out is not available. There is a hardship file. The owner still controls the money. | Served, frozen account, or confession of judgment — that is a lawyer today. Panic calls instead of a file. |
| Legal restructure with counsel | The funder will not cooperate, or there is already a legal event (served, frozen, COJ). | You want us to file, stop ACH as the actor, or give legal advice. We do not. |
| Bankruptcy | Licensed counsel says the file belongs there. | You want a consulting firm to file Chapter 11. We do not file. |
What not to do
Do not take another advance to service the last one. That is the stack, and the fourth one is the trap. Stacked merchant cash advances.
