Negotiate from a file, not from panic
We are not a debt settlement company and we do not hold funds.
Negotiation is the second move. If refinance / take-out is not on the table, we work the file with the funder — remaining balances, ACH, UCC, personal guarantee, and what done has to look like. Panic is not a file. A hallway call is not a file. See how we work an MCA file.
A hardship file
The hardship file is the owner's facts: cash including daily ACH, payroll, the stack, the contracts, the liens, the guarantee, and what the operating account can actually do. Leverage, if there is any, comes from those facts — not from a threat letter and not from a mill script.
Reduced payment vs defined payout
Two different closes. A reduced payment is a debit the cash flow can live with. A defined payout is a number that ends the MCA. We do not treat them as the same thing. We do not promise a percentage. We do not promise what a funder will accept.
Close docs
If there is a close, the documents have to match done. That means:
- A zero-balance letter
- A UCC-3 deadline
- Personal guarantee release
- No same-day wire
Without those, you do not have done. You have a conversation. You stay the owner. You stay in control of the money.
If the funder will not cooperate
Negotiation is not theater. If the funder will not move, the next step is legal-path prep with licensed counsel. We are not a law firm and we do not provide legal advice. If you have been served, if the account is frozen, or if there is a confession of judgment, that is a lawyer today.
